These Terms of Service ("Terms") are an agreement between you and Carmona OS LLC ("Carmona OS," "we," "our," or "us"). They govern your access to and use of the Carmona OS mobile application, website, subscriptions, content, and related services (collectively, the "Service"). By using the Service, creating an account, or purchasing a subscription, you agree to these Terms.
You must be at least 18 years old to use the Service. You are responsible for providing accurate account information, maintaining the security of your sign-in credentials, and for activity that occurs through your account. If you believe your account has been compromised, contact us promptly.
The Service provides fitness, workout, nutrition, and coaching-related information for educational and informational purposes only. The Service does not provide medical advice, diagnosis, treatment, physical therapy, or emergency services. You should consult a physician or qualified health professional before beginning or changing any exercise, nutrition, supplement, or wellness program, especially if you have a medical condition, injury, disability, or other health concern.
Exercise and nutrition changes involve risk. You are responsible for exercising within your abilities, using proper equipment and technique, and stopping if you experience pain, dizziness, shortness of breath, or other concerning symptoms. You assume the risks associated with your use of the Service and your participation in any workouts or recommendations.
Carmona OS includes access to the first six completed workouts without a paid subscription. Continuing with Workout 7 and later workouts requires Carmona OS Premium. In the United States, Carmona OS Premium is offered for $14.99 per month or $119.99 per year. Prices may vary by country or region, and the App Store price shown before purchase is the price that applies.
Premium subscriptions are processed by the Apple App Store and charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically for the same billing period unless you cancel at least 24 hours before the end of the current period. Your Apple Account may be charged for renewal within 24 hours before the current period ends. You can manage or cancel your subscription in your Apple Account subscription settings.
No introductory free trial is included unless one is expressly shown in the App Store purchase flow. Deleting the Carmona OS app or your Carmona OS account does not cancel an Apple subscription. Refund requests and App Store billing disputes are handled by Apple under its applicable terms and policies.
You may submit information such as workout history, preferences, exercise performance, account information, and feedback. You retain any rights you have in your own submitted content, but you grant Carmona OS LLC a limited license to use, host, process, display, and analyze that content as needed to operate, personalize, secure, support, and improve the Service.
Our collection and use of personal information is described in our Privacy Policy.
The Service, including its software, design, workout programming, training logic, copy, graphics, trademarks, trade dress, and other content, is owned by Carmona OS LLC or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use.
You may not copy, modify, distribute, sell, reverse engineer, scrape, or create derivative works from the Service except as permitted by law or with our written permission.
The Service may use artificial intelligence to generate coaching feedback, summaries, recommendations, or other outputs. AI-generated content may be incomplete, inaccurate, or inappropriate for your individual circumstances. You are responsible for reviewing outputs before relying on them, and you should not use AI-generated content as medical, legal, financial, or professional advice.
You agree not to misuse the Service, interfere with its security or operation, access it through unauthorized automated means, attempt to obtain another user's data, upload harmful code, impersonate others, violate applicable law, or use the Service in a way that infringes the rights of Carmona OS LLC or any third party.
We may modify, suspend, or discontinue parts of the Service at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available on every device or platform. We may update these Terms from time to time by posting the updated version and changing the effective date.
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Carmona OS LLC disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
To the fullest extent permitted by law, Carmona OS LLC and its owners, officers, employees, contractors, agents, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or business interruption arising from or related to your use of the Service.
To the fullest extent permitted by law, Carmona OS LLC's total liability for claims arising from or related to the Service will not exceed the greater of the amount you paid to Carmona OS LLC for the Service in the 12 months before the claim or $100.
You agree to defend, indemnify, and hold harmless Carmona OS LLC and its owners, officers, employees, contractors, agents, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, your submitted content, or your violation of applicable law or third-party rights.
You may stop using the Service at any time. We may suspend or terminate your access if we believe you have violated these Terms, created risk for Carmona OS LLC or other users, or used the Service unlawfully. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles, except where applicable law requires otherwise.
